These Terms and Conditions set out the basis on which Rubbish Removal Hampstead provides rubbish removal, waste collection and related clearance services. By booking a service with us, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions, the following expressions have the following meanings:
Service means any rubbish removal, waste collection, clearance, loading, transportation, disposal or associated service provided by Rubbish Removal Hampstead.
We, us and our mean Rubbish Removal Hampstead, the waste service provider.
You and your mean the customer who requests a Service from us, whether as an individual, company, landlord, tenant, agent or other entity.

2. Scope of Service
2.1 We provide waste collection and rubbish clearance services for domestic and commercial customers within our operational area. Our services include collection, loading, transport and lawful disposal or recycling of Waste.
2.2 The exact scope of the Service, including the expected volume of Waste, access requirements, and any additional labour or time likely to be required, will be agreed with you at the time of booking or during our attendance at your premises.
2.3 We reserve the right to decline to provide the Service or to remove certain items where it would be unsafe, unlawful or impractical to do so, or where the Waste presented differs materially from that originally described.
3. Booking Process
3.1 You may request a booking for our rubbish removal and waste collection services by telephone, email, online form or any other communication method we make available.
3.2 When making a booking, you must provide accurate and complete information, including but not limited to the type and approximate quantity of Waste, the collection address, access details, parking arrangements and any relevant timing constraints.
3.3 Any quotation provided before our arrival is based on the information you supply. Quotations are estimates only and may be revised upon inspection of the Waste at the collection address.
3.4 A booking is only confirmed when we issue a confirmation to you by email, text message or other written method, or when we arrive at the collection address and you agree to proceed with the Service and any updated price we may provide.
3.5 We may request photographs of the Waste in advance of attendance in order to provide a more accurate estimate and to determine access and loading requirements.
4. Access and Parking
4.1 You are responsible for ensuring that we have safe, reasonable and lawful access to the collection address and to the Waste. This includes obtaining any necessary permissions from landlords, managing agents, neighbours or local authorities.
4.2 You must ensure that suitable parking is available for our vehicle as close as reasonably possible to the collection address. Any parking charges, permits or penalties incurred as a result of providing the Service may be added to your invoice.
4.3 If we are unable to gain access to the collection address or the Waste due to circumstances within your control, we may charge a wasted journey fee or a reasonable call-out fee to cover our time and costs.
5. Pricing and Quotations
5.1 Our charges for rubbish removal and waste collection are generally based on the volume, weight, type of Waste and the time required to complete the Service, along with any travel, congestion or parking costs.
5.2 Any price given before we attend is an estimate only and is not binding until the Waste has been inspected. If the actual Waste differs from your description or requires additional time, labour, equipment or disposal costs, we reserve the right to revise the price accordingly.
5.3 In the event that you do not agree to a revised price, you may decline the Service, but we reserve the right to charge a reasonable attendance or call-out fee to cover costs incurred.
5.4 All prices are quoted in pounds sterling and may be subject to VAT or other applicable taxes, where relevant.
6. Payments
6.1 Payment for the Service is due on completion of the collection, unless otherwise agreed in writing in advance.
6.2 We accept payment by cash, bank transfer, or debit and credit card, subject to any methods we make available at the time of Service.
6.3 For business and account customers, alternative payment terms may be agreed in writing prior to the booking. Where we extend credit, invoices must be paid in full by the due date specified. We reserve the right to charge interest and reasonable recovery costs on overdue amounts.
6.4 You are responsible for ensuring that payment details are accurate and that sufficient funds are available. If payment fails or is reversed, we may suspend further Services until full payment is received.
7. Cancellations and Amendments
7.1 You may cancel or amend your booking by contacting us as soon as reasonably practicable.
7.2 If you cancel more than 24 hours before the scheduled collection time, no cancellation charge will normally apply.
7.3 If you cancel less than 24 hours before the scheduled collection time, we reserve the right to charge a reasonable cancellation fee to cover administrative and scheduling costs.
7.4 If we arrive at the collection address at the agreed time and are unable to carry out the Service due to circumstances within your control, including but not limited to lack of access, absence of an authorised person to grant entry, or refusal to proceed with the Service, we may charge a wasted journey fee or a portion of the quoted price.
7.5 We may cancel or reschedule the Service if we are unable to attend due to operational issues, staff illness, vehicle breakdown, severe weather, safety concerns or other circumstances beyond our reasonable control. In such cases, we will notify you as soon as reasonably practicable and, where possible, offer an alternative appointment.
8. Customer Responsibilities
8.1 You must ensure that all Waste intended for collection is clearly identified and separated from any items that are not to be removed.
8.2 You must not present for collection any hazardous, dangerous or prohibited materials, including but not limited to asbestos, medical or clinical waste, explosives, gas cylinders, large quantities of chemicals, solvents, oils or liquids, unless we have expressly agreed in writing in advance to remove such items and you have complied with any additional requirements we specify.
8.3 You are responsible for ensuring that any Waste stored outdoors is reasonably contained and accessible, and that any sharp, heavy or awkward items are made as safe as reasonably possible for handling.
8.4 You must not include in the Waste any personal data, confidential documents or items of special value without taking appropriate steps to safeguard your interests. We do not accept responsibility for the loss of any item that you did not clearly identify to us as not for removal.
9. Waste Handling and Regulations
9.1 We operate in accordance with applicable waste management and environmental laws and regulations for the handling, transportation and disposal of Waste.
9.2 By engaging our Service, you confirm that you are the owner of the Waste or have the authority of the owner to arrange its removal and disposal.
9.3 Once the Waste is loaded onto our vehicle, it becomes our responsibility and we will transport it to an authorised facility for disposal, treatment or recycling, in line with regulatory requirements and our operational policies.
9.4 We may, at our discretion, sort or separate Waste for recycling or recovery. You agree that we may decide, acting reasonably, how best to deal with the Waste in compliance with relevant legislation.
9.5 You agree not to instruct us, or knowingly permit us, to handle or dispose of Waste in any way that would contravene applicable law or regulations.
10. Property and Site Condition
10.1 We will take reasonable care when carrying out the Service at your premises. However, clearance and removal work can involve moving bulky, heavy or awkward items, and there is a risk of minor damage, particularly to flooring, walls, door frames and other surfaces.
10.2 You are responsible for protecting any areas or items that are particularly fragile or valuable, including by covering floors or removing items that may be at risk.
10.3 We accept no liability for pre-existing damage or structural defects, or for damage caused by moving items through tight spaces where no reasonable alternative route is available and you have asked us to proceed.
11. Liability and Limitations
11.1 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter where liability cannot lawfully be limited or excluded.
11.2 Subject to the paragraph above, our liability to you for any loss or damage arising out of or in connection with the Service, whether in contract, tort or otherwise, shall be limited to the total price paid or payable by you for the specific Service giving rise to the claim.
11.3 We shall not be liable for any indirect, consequential or special losses, or for any loss of profit, revenue, business, contracts or anticipated savings.
11.4 We shall not be responsible for any loss of or damage to items that were not reasonably identifiable as not forming part of the Waste to be removed, or where you failed to inform us that certain items should not be taken.
11.5 You agree to indemnify us against any claims, losses, damages or expenses arising from your breach of these Terms, including but not limited to any claim relating to Waste that you were not entitled to dispose of or that you misdescribed.
12. Missed Items and Complaints
12.1 If you believe that we have failed to remove items that were agreed as part of the Service, you must notify us as soon as reasonably practicable and in any event within 48 hours of completion of the Service.
12.2 We will review any complaint received and, where appropriate, arrange a return visit or offer an alternative resolution. Any remedy will be at our discretion, acting reasonably and in line with these Terms.
12.3 If you are dissatisfied with any aspect of the Service, you should contact us promptly with details of your concern so that we can investigate and respond.
13. Events Beyond Our Control
13.1 We shall not be in breach of these Terms nor liable for any delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control.
13.2 Such events may include, but are not limited to, severe weather, traffic disruption, accidents, vehicle breakdown, industrial disputes, fire, flood, acts of government or regulatory authorities, or any other event of a similar nature.
14. Data Protection and Privacy
14.1 We will collect and use personal data provided by you for the purpose of managing bookings, delivering Services, handling payments and dealing with any enquiries or complaints.
14.2 We will take reasonable steps to keep such personal data secure and will not share it with third parties except where necessary to deliver the Service, process payments, comply with legal obligations or with your consent.
15. Variation of Terms
15.1 We may amend these Terms and Conditions from time to time. Any updated Terms will apply to new bookings made after the date of publication of the changes.
15.2 The Terms that apply to your booking will be those in force on the date that you make the booking, unless you agree otherwise in writing.
16. Severability
16.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or other competent authority, that provision shall be deemed severed and the remaining provisions shall continue in full force and effect.
17. Governing Law and Jurisdiction
17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.
17.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service.
